Trial Day 5 Friday may 13

I am still stuck on Thursday’s questioning from Defense Attorney Ann Finnell;
she asked Judge Perry if potential jurors could be asked about the following “mitigating circumstances”, about a defendant who suffered the following things as a child-
“lack of maturity”
“lack of impulse control”
“history of sexual abuse”
“verbal and emotional abuse”
“lack of parental guidance”
“mother and father failed to protect her as a child”
“she was verbally and emotionally abused as a child.”
“she was taught poor coping and has poor coping skills by normal standards”
“she was taught to project false appearance”
“she was used as a decoy or pawn by her parents and a scapegoat for parental misconduct”
After thinking for a while about this angle the defense seems to be leaning towards I wondered if this would finally be the “straw that broke Cindy and George Anthony’s back”. It is a horrible thing Casey Anthony has and is accusing her father and brother of and by all accounts Anthony’s Attorney has said multiple times today they will sue anyone that accuses George Anthony of molesting his daughter. However rather than direct your anger at the person responsible for the upcoming “abuse angle” the defense team of your daughter, the parents are threatening former attorney Brad Conway. Seriously what is Cindy and George Anthony afraid of the “truth” and all the criminal things they have done coming to light.
Mark Lippman told the Orlando Sentinel that Brad Conway made “huge ethical violations” when talking about his former clients in recent days on national television.

Another day of #CaseyAnthony jury selection begins. Casey and all the key players are in court. Perry wastes no time getting things started.
Juror 10 takes the stand. She is a white female, probably in her late 50s or early 60s.Judge Perry is asking the potential juror about her prior knowledge of the CaseyAnthony case.Prosecutor Drane Burdick begins her portion of the voir dire relating to the question of pretrial publicity.Judge Perry now moves to the issue of the death penalty..Attorney Baez now begins the defense portion of the pretrial publicity voir dire.The potential juror says that she believes in the death penalty in certain circumstances.Prosecutor Ashton begins the State's portion of the death penalty voir dire. Attorneys approach the bench to can discuss a matter in private with the potential juror. It concerns her adult daughter. Following a prosecution objection, Baez asks for a sidebar.The voir dire of this potential juror is complete. Neither side challenges her as a juror and will be recalled tomorrow morning.  Perry says he'll start asking the attorneys about back strike peremptories as soon as they pass 12 potential jurors. Perry goes on to say tha they will get through 12 potential jurors on the pannel by tonight. The judge calls a five minute recess before the next juror is brought in for CaseyAnthony jury selection. Judge Perry takes the bench. The next potential juror is called in.

Judge Perry addresses the potential juror on that issue. Ashton begins the State's portion of the death penalty voir dire.The defense is now on its portion of the death penalty voir dire with Finnell taking the lead. Following a prosecution objection, the attorneys go to a sidebar. Sidebar ends. Finnell resumes her questioning.  An upcoming juror is apparently getting sick. Perry will let that juror leave for the day
, perhaps to return tomorrow.The juror is released and the court will check on the tomorrow.
Questioning continues with the present juror. The prosecution has no challenge, but the defense challenges him for cause.George argues against excusing this juror for cause. Ultimately, the judge asks the juror to come back in.
Judge Perry calls a 40 minute lunch recess. Court is in recess until 12:30. The defendant leaves the courtroom.Because of the short lunch recess, all of the parties in this case are eating their lunch fast in the courthouse cafeteria. Potential jurors were brought to the cafeteria to pick up lunches, escorted by a dozen court officers and are eating their food elsewhere.
CaseyAnthony is back in the courtroom. Perry takes the bench and the next potential juror is brought in. 
 The potential juror is an African-American male, in his 30s or 40s. Drane Burdick begins the State's portion of the pretrial publicity voir dire .Baez now begins his portion of the publicity voir dire. Judge Perry now moves to the issue of the death penalty. The potential juror ust told Perry that he doesn't believe in the death penalty. Baez gets started his portion of the general voir dire for CaseyAnthony jury selection.Neither side has a challenge for this juror, so he remains in play He is brought back into the courtrom, and asked to return at a later time. Perry has now called for a 5 minute recess. Its a good time to stretch your legs!
In recess now for 5 min. The attorneys are joking about how they've been able to pick up the pace of jury selection. Judge Perry returns to the bench. He sends for the next potential juror.
Juror #27 takes the stand. She is a white female, in her 30s. Judge Perry begins his preliminary questions on the issue of pretrial publicity. The witness says she had never heard of this case until her mother called her about it last week. George does not question her long. Baez begins his portion of the pretrial publicity voir dire, but wraps it up pretty quickly too. Perry moves things along to the death penalty portion of the voir dire. The potential juror says she is for it under the right circumstance. When Finnell asks about mercy being a possible mitigator, Ashton objects and says he has case law on that issue. Now they are at a sidebar. Sidebar end.Finnell has resumed her death penalty questioning. Before she began, judge Perry asked his law clerk to check on some case law. Frank George continues with the State's general voir dire for CaseyAnthony jury selection. The juror says she used to watch Court TV, but stopped when it became truTV.  The juror returns, and is told she will likely return back tomorrow. She then leaves the courtroom.
Before the next juror, the Perry leaves the bench to check some case law. We are in a recess.
Judge Perry is back on the bench. Ashton asks to approach the bench, saying "I have a confession to make." The attorneys have a brief sidebar.The judge says the issue at hand involves whether a potential juror can be asked if they would consider mercy when considering whether or not to impose the death penalty. Both sides have case law to support their positions. Ultimately, Judge Perry decides that the mercy question can be asked.  Perry now addresses case law re: the prosecution's possible plan to have jurors smell odors from cans (re: the decomposition odor issue. Perry has found case law from TX that doesn't seem to allow it, but one from NM that might. Ashton then offer additional cases.
 The next potential juror is up. She is an African-American female in her 50's. Judge Perry questions the juror about her previously-stated position that she doesn't feel comfortable judging others.She says, however, that that position would not keep her from being a juror in this case ("I have no problen with it"). After only a few questions, Ashton is finished. Baez now begins his portion of the pretrial publicity voir dire. Ashton comes back to do the State's death penalty voir dire. The defense has no death penalty questions for this witness. The prosecution then says it has no general voir dire questions. State announces it would exercise a peremptory challenge to this juror. The defense makes a Batson challenge.The State responds that she said she didn't like judging others. The State offers some more reasons why this juror is being challenged. Judge Perry then DENIES the State's peremptory challenge.The juror is brought back into the room, and told to report back tonorrow. Before the next juror, the State asks for a sidebar. The prosecution wants to discuss the potential jurors "qualifications to serve". The sidebar ends. CaseyAnthony jury selection is in a recess for at least 5 minutes.
Perry sends for the next potential juror, a Hispanic male in his 20s. As soon as the new potential juror enters, he is asked to address the judge and attorneys in confidence. The parties now go back to their normal places. Judge Perry welcomes the juror, and asks him about his knowledge of pretrial publicity. Judge Perry now moves to the issue of the death penalty. Ashton just did his questioning of the potential juror re: the death penalty. Now its Finnell's turn. Through all the questioning, CaseyAnthony 's expression never changes.She occasionally jots down a note, but her expression never varies. The judge reads the juror an instruction re: mitigating circumstances. He couldn't consider the defendant's age as a mitigator. Perry seems to want to do another 8 potential jurors before the end of the night for CaseyAnthony jury selection. Mason objects, says going so late is "beyond endurance." He asks for no more than three or four more jurors today. Judge Perry says its will be a full day on Saturda yand that as soon as there are 12 jurors pass, he intends to swear them in.
Per reports,all of the reporters have left the courtroom. Its about that time when folks are getting to be time for the 5:00 live shots!
Judge Perry is back on the bench to continue jury selection. The defense asks for a sidebar.Back from sidebar now for jury selction. Finnel challeges that the potential juror be excused for cause with Perry grants.
The next juror is 34. He is a white male in his 20s. He says he has hardship and is excused for cause.

The next juror is a white male in his 60s. Judge Perry is questioning him on his knowledge of pretrial publicity.Baez starts to question the witness. But before he can start, the judge asks the juror to leave the room.The gent thought she was guilty based on stuff he heard/read in 2008. He was not sure he could put aside what he read (& what made him think she was guilty). It was a convoluted position or least the way it came out was convoluted.
Perry is now addressing the attorneys on working #CaseyAnthony jury selection on Sat. Perry says that they will work a full day tomorrow .Ashton suggests a more limited number of jurors come in tomorrow. He notes that "in all likelihood" this process wll continue on Monday.  There are 21 jurors being asked for tomorrow. The prosecution asks for a few minutes to talk to CaseyAnthony 's defense
