Day 4,

Judge Perry is now on the bench.

When Judge Belvin Perry reconvened Thursday morning, Anthony's attorneys made reference to turning off certain microphones in the Pinellas, courtroom because conversations at the defense table were being quoted in media reports.

A specific reference was made to an online article where Jose Baez reportedly told his client to "stop acting like a 2-year-old."

"It puts the entire process in peril," said Baez.

Judge Perry told Baez the microphones will remain on in court.

The Judge told Baez, "I've done all I can do. This is America." Perry denies the defense request to shut off all mics and cautions the parties to be careful about what is said in a public courtroom

Anthony's attorneys made reference in court to a mitigating factor that their client suffered sexual abuse as a child and had poor coping skills and a lack of maturity

The potential juror is not present. The attorneys are discussing the extent to which the defense may ask the prospective juror about mitigating circumstances.Mitigating circumstances re: whether the potential juror could consider both death and life in prison,  be convicted. Perry rules against the defense, limiting the scope of voir dire regarding specific possible mitigators. Juror 1/1340 returns to the stand. The death penalty portion of this potential juror's voir dire is now over. Prosecutor Drane Burdick now moves to general questioning on pre-trial publickity. As the questioning of this juror continues, the number of reporters inside the courtroom has thinned out somewhat, per reports.
