Casey Anthony Trial Day 7. May 16

dJudge Perry is on the bench for the second week of jury selection.A potential juror was just dismissed due to illness.A potential juror was just brought in to discuss vacation conflict.The potential juror with a vacation conflict has been called for voir dire out of order. 
Judge Perry is asking a potential juror (a woman in her 30s) about pretrial publicity. I have heard a little about the case, but I don't really have any prejudgments. The potential juror is talking about seeing Jose Baez on TV before the trial started.
So far, 12 jurors (6 men and 6 women) will make it to the next round of questioning.Defense attorney Jose Baez is questioning a potential juror about pretrial publicity. The potential juror says she doesn't know if #CaseyAnthony is innocent, but the defendant has a right to a fair trial. The potential juror is a nurse. Judge Perry is now asking her about her feelings on the death penalty. The potential juror says she's not against the death penalty, but she doesn't have any strong feelings either way. The potential juror says she could vote for a death sentence or life in prison if it's necessary. This potential juror has two young children. Defense attorney Ann Finnell is asking a potential juror about the death penalty.Defense attorney Ann Finnell said she caught a summer cold. That's why she sounds so congested. The potential juror says she would vote her own mind on the death penalty, and wouldn't force her opinions on anyone else. Potential juror: if the person was an adult (over 18) I don't think age would come into play as a mitigating factor. Juror: I would not hold it against her chose not to testify.This juror isn't concerned about the media coverage on this case. She's being questioned by Prosecutor Linda Drane Burdick. The juror recalled that her car was stolen years ago. It was recovered without incident. Juror: my children (ages 5 and 2) see their grandparents quite a bit.  I've always wanted to be part of a jury" -Potential juror answering defense attorney Jose Baez. Jose Baez is explaining the consideration of lesser included charges in this case. The potential juror has left the courtroom. Remember each side has 9 peremptory challenges. Defense wants to excuse the juror. Defense: the juror could not consider age or mercy, and has a problem with the presumption of innocence. The state objects to the defense challenge that the juror be dismissed for cause. Judge Perry: no rebuttal, you get one shot, folks. The defense has used one of it's peremptory challenges to dismiss this juror. The prosecution has 9 peremptory challenges left. The defense is down to 8.The attorneys are conferring with Judge Perry in a sidebar.
The sidebar is over, and the court is about to bring in the next potential juror. This potential juror is a white man in his 30s. Judge Perry is asking him about pretrial publicity. This potential juror is in Orlando for business about once a week. Juror: I pay more attention to international news than local news. I occasionally watch CNN. The potential juror's wife has followed this case in the news from the beginning. The potential juror says he has no opinion about the death penalty.  Prosecutor Jeff Ashton: deciding the death penalty will be the most important decision you will ever make for another person.
Defense attorney Ann Finnell didn't question the juror about death penalty. Prosecutor Frank George is on general voir dire. This potential juror worked as a chef, now he’s in the restaurant industry but not the kitchen.  The juror has son who is 6, and a daughter who is a year and a half. The potential juror is outside of the courtroom. The prosecution has no cause to strike the juror. The defense also has no challenges to this potential juror.Court is in a five minutePotential juror:
Court is back after a short break. The next potential juror is being called into court break. This potential juror is a white woman in her 40s. She's answering questions about pretrial publicity. Potential juror: "I'm the daughter of a lawyer, so I believe in the system." 
 Juror: I can set aside what I've heard about Casey Anthony, but I wish my answer was different so I could go home! This potential juror's mother is a retiring lawyer in Pinellas county. The juror recalls Casey Anthony taking police to Universal early in the investigation. Potential juror: I watch CNN, but not HLN. It's a different kind of channel. . The juror says she is a CNN junkie...but didn't watch local news. Jose Baez questioning potential juror on pre-trial publicity. The juror said she deleted online  news from her computer this week. Both sides pass on asking death penalty questions and general voir dire begins with Linda Drane Burdick for the state.The juror was a victim of a home robbery. She does remember speaking with the State Attorney at the time. This was in 1990. The defense begins its portion of general voir dire. The juror dated a prosecutor from North Florida but she says she isn't in touch with him anymore. General voir dire is over and the Defense moves to challenge the juror for cause, for forming pre-trial publicity opinion. Defense chooses not to use a pre-emptory strick for the last juror, bringing the total number of potential jurors to 14.Lunch until 1p. 
The defendant is back in the courtroom after lunch recess for more jury selection . Judge Perry is back on the bench and is addressing a housekeeping matter.
A potential juror was excused due to ongoing chemotherapy treatments.
 Another potential juror has been called in for questioning. Judge Perry advised defense attorney Ann Finnell to take some vitamin C to help with her cold.The potential juror being questioned is a white man in his 20s. He recalls hearing CaseyAnthony 's name, but can't remember details.  The prosecution is questioning the potential juror about pretrial publicity CaseyAnthony. Juror: at least 10 people have asked about my jury duty. I didn't tell them I was on the case. The defense has no questions on pretrial publicity for this juror. Judge Perry tells the potential not to worry about his scheduling conflict in July. On to questions about the death penalty. The potential juror has no opinions on the death penalty. Defense attorney Ann Finnell is questioning the potential juror about the death penalty. The potential juror rates his opinion on the death penalty on a scale of 1-10 at a 5. Ann Finnell said this morning she has a summer cold. She came back from lunch sounding a little more congested. Prosecutor Frank George is questioning the potential juror for general voir dire.The juror says the cameras in the courtroom don't make him nervous . The juror is 22 and single. The potential juror is hoping to be an RN in a few years. He's working towards that goal with his current job. The juror's older brother is away from the family, he's probably around 30. He also has a younger sister.The potential juror's Dad is a little angry about his son's jury duty. He does not want to miss the cruise. Jusdge Perry will check and see if juror will lose money invested in trip if he is choses to serve.The potential juror lives with his father. He helps out around the house, but doesn't pay for anything.Defense attorney Jose Baez is questioning the potential juror in general voir dire. Juror's hobbies: shooting guns and working on his car.The juror left the courtroom. The prosecution has no challenges, and neither does the defense. He will return.

This potential juror is a hispanic man and has a sister who was very ill last week. She's okay now, but not out of the woods. The potential juror has left the court and is excused for his and his family's medical concerns.
 Another juror is called to the courtroom for questioning. This juror, a white man in his 30s, says he heard about #CaseyAnthony on the news years ago, but he's not a regular news viewer. Juror: People at work have asked me if I was on the trial. I told them I couldn't talk about it. The state is asking the juror about pretrial publicity.  The defense has no questions about pretrial publicity, so Judge Perry moves on to the death penalty questioning. Juror: I'm not a strong advocate for or against the death penalty either way. The state has no questions about the death penalty. On to defense attorney Ann Finnell.This juror is 36 years old and married. This juror served in the army then got a degree in political science in Roanoke, Virginia.Defense attorney Cheney Mason is questioning the potential juror in general voir dire.  The potential juror has an acquaintance also in the potential jury pool. He said it would not change his decision. The potential juror was arrested in the '90s for a DUI and was not convicted. He did not mention that on his jury form.The juror has a 13 month old son. Potential juror: I am confident I can make an impartial decision. The potential juror has stepped out of the courtroom. Neither side has any challenges. He will return for more questions. Court is in a quick recess and will resume shortly.
The judge is back on the bench. Another potential juror has been brought in. This potential juror is a white woman in her 50s. She confirms that she's stuck to Judge Perry's admonition.Judge Perry is asking the potential juror about pretrial publicity. She seems to know a great deal from various news programs .Juror: Casey Anthony was not helpful in the investigation. She lied to police. Potential juror: I believe CaseyAnthony is guilty. Potential juror: I don't believe I can set aside what I already know about CaseyAnthony as a mother and a nurse. Judge Perry commends the potential juror for being so candid about her opinions in this case. She steps outside. Neither side has any questions. The court strikes the potential juror for cause. The next potential juror is a white woman in her 60s. Potential juror: My anti-virus software ran out. I haven't used the computer. This potential juror has a fair amount of knowledge about this case. She recalls that the girl's grandmother called police. She remembers Casey Anthony was very "visually upset" when Caylee's body was found CaseyAnthony. The juror mentioned some pretrial hearings. She says she might have seen some on In Session, but wasn't paying close attention. She remembers the hearings about the admissibility of certain evidence. Specifically, telephone calls from jail.Potential juror: I might have listened to some of those calls, but honestly I don't remember. Potential juror: "Some people will say she's guilty, but of what? What's the proof? I don't know." This juror says she feels CaseyAnthony is guilty, but she's not sure what Anthony's guilty of. The juror says she can set aside her knowledge and presume CaseyAnthony is innocent in this trial.  Potential juror: "I believe a person has to be found guilty beyond a reasonable doubt". This juror has no hesitation to decide based solely what she hears in evidence. Linda Drane Burdick is asking this potential juror about pretrial publicity. She watches local news and CNN. Juror: I saw the attorneys and the judge on In Session. It was a hearing to determine whether phone calls would be alloJuror: I listen a little of the commentary on In Session. Juror: "I'm a surfer" when describing what sources she heard news about CaseyAnthony. She recalls the theory that #CaseyAnthony used something to put the baby to sleep and it went too far. The potential juror mentions "Project Innocence" saying that not everyone in prison is necessarily guilty. Juror, referring to defense attorney Cheney Mason: The fellow with the beard looks familiar. This potential juror was a teacher for 19 years. The defense has no questions. The state has started questioning this potential juror in general voir dire. The juror has two sons, ages 41 and 43. My son adopted two of his wife's children. Juror: I visit my son's quadruplets about twice a year. Juror: a man I was dating was mugged outside of a grocery store. We ended up in the hospital. Juror: My son was once falsely accused of rape, but later the police realized the mistake and released him. Juror: Casey Anthony doesn't seem to have any direction or goals in her life. Juror: George and Cindy Anthony are concerned and involved grandparents. The potential juror insists she can put aside the things she already knows and the opinions she already formed. Defense attorney Jose Baez is questioning this potential juror in general voir dire. Juror: I like Oprah books and I like Grisham books.One of this juror's favorite books is "The Lovely Bones," a book about a young girl who was murdered. The prosecution used one of its peremptory challenges on this juror. She's excused. Both the prosecution and defense have 8 peremptory challenges left. Court is back in session, a new potential juror has been brought in.This juror says he has heard about the case, but doesn't know much about it. He doesn't have an opinion about CaseyAnthony. Now the prosecution's questioning. Juror: I remember there was a missing child and the mother was suspected. I don't remember how they found her, but they did CaseyAnthony. Potential juror: I don't tweet, I just follow. I do post on Facebook when my kids do something I'd like to share.This juror says he has to stay on top of the news for his job, which is in finance. Potential juror repeats: "I think I can" when asked if he can set aside what he knows and be unbiased .Judge Perry is now talking about the death penalty with the potential juror.The juror is for the death penalty .Ann Finnell's voice is going away quickly due to her cold.The juror's wife is a teacher. He has two boys, ages 6 and 7.The juror has a back issue that makes it difficult for him to sit for too long . However, he states, when asked , he would be able to serve. The juror is outside the courtroom. The defense challenges due to the juror's back condition. Jose Baez wishes to contiue with objection to juror. Judge Perry states once Jose sits down, he is not entertaining anymore questions. Jose continues. Jose objects to object in regard to his answer if Casey Anthony's involvement. Expresses concern to his retpeated answer, "I'll try". Judge refuses to dismiss juror "for cause".Defense and Prosecution refuse to use the preemptory challenges. No backstrikes which to be utilized.

Judge Perry states that tomorrow he will bring n 3-4 more jurors for interviews and by afternoon he intends to swear in 12 and whatever for left for alternates.It is now longer certain there will be a total of 8 alternates. Judge: "We will have what we will have."   Adjourned until 830 AM tomorrow.
