Defense Expected Witness List


Among those on the list:
•Dr. Henry Lee, the well-known criminalist and forensic pathologist often associated with the O.J. Simpson case. According to his website, Lee is founder and professor of the Forensic Science Program at the University of New Haven. During a 40-year period, Lee assisted with the investigations of some 6,000 cases.
Casey Anthony defense attorney Jose Baez called Lee "probably the world's foremost crime scene detective." He will testify about evidence from the recovery scene where Caylee Marie Anthony's remains were found, Casey Anthony's car and other areas.

 Dr. Tim Huntington, an assistant professor at Concordia University, Nebraska, and a board-certified entomologist. Forensic entomology applies the study of insects to a legal context to help establish times of death and postmortem movement of bodies.
• Richard Eikelenboom, a renowned Dutch forensic expert who, along with his wife Selma, is a partner at Independent Forensic Services, a Netherlands lab specializing in trace evidence recovery and Touch DNA testing. They are considered pioneers in the field of "Touch DNA." Richard Eikelenboom is a DNA expert who handles blood-pattern analysis.
Other experts listed by the defense are:
•Dr. Werner Spitz, from Michigan. Baez called Spitz "the grandfather of forensic pathology." Spitz, too, has been involved in other high-profile criminal cases. He also conducted Caylee's second autopsy, Baez reminded.
•Dr. Kathy Reichs, of North Carolina; Baez said Reichs is "the inspiration for the television show Bones." She is a well-known Dr. Reichs is an anthropologist and author.
•Dr. Jane H. Bock, of the University of Colorado Ecology and Evolutionary Biology Department; Baez said Bock is a "forensic botanist," one of the most qualified in that field. Bock often works for the prosecution, Baez noted.
•Dr. Scott Fairgrieve, chair of the Department of Forensic Science at Laurentian University in Ontario; He is a forensic anthropologist.
•Dr. Kenneth Furton, of University Medical & Forensic Consultants, Inc., in West Palm Beach. Furton is a forensic chemist;
•Dr. Barry Logan of National Medical Services, Inc., in Willow Grove, Pennsylvania, also a forensic chemist;
•Dr. John Leeson, of Winter Springs, a digital forensics expert;
•Dr. William C. Rodriguez, of Maryland, another well-known forensic anthropologist and co-founder of the so-called "Body Farm" or the University of Tennessee Anthropological Research Facility, which studies the decomposition of human remains. He is an unpaid consultant.
•Dr. Michael Freeman, forensic epidemiologist;
•Michael O'Kelly, an expert witness out of Nebraska, who specializes in cell phone tower operations.

855A> Casey Anthony just arrived to court She busies herself with papers on the desk. She is smiling and greets attorneys as they arrive.
BREAKING NEWS!!! The defense's private investigator took video inside the Anthony home of Casey and Caylee's room.  In the notice from the defense they also handed over pictures they say Cindy Anthony sold to 48 Hours. Also, they are presenting a witness, a convicted kidnapper they said George talked to on his cell phone 4 times on July 15, 2011. The day before Cayless' remains were discovered.
Judge Perry (JP) is on the bench. The Jury is returned. 
Gerardo Bloise is called to the stand.  July 30, 2011, Gerardo Bloise investigated Tony Lazarros' vehicle. He checked the car for stains. He testifies the car was negative for blood. He did not put the car of a "lift."   He did not collect any items from Tonys' car.
August 6th, 2008 > He executed a search warrant at the Anthony Home. He searched Caseys' room . He used alternative light sources to check for body fluids in room and clothes.  He checked livingroom, garage and car area. He did a visual inspection. George and Cindys room. Baez  shows pics of Caseys' rooms . The pic is entered into evidence .He identifies the objects in Caseys' room. He identifies pic of Caseys' closet .He checked the pants from Caseys' car, found the day the car was retreived for the car tow lot, July 16, 2008.. The were negative for blood. However, I  recall Cindy had washed them. 
Bloise is being questioned as to the methodology of search. What he wore for the search, protective cover and hat. Baez asks if he wore a mask. Boise>NO Baez>Did you talk during the search. Bloise> No Baez> Why not? Bloise> I was by myself. Baez and the whole courtroom laugh. 
Prosecution asks ab out Cindy washing the pants prior to inspection .Bloise said he knew that she did but they did the liht search anyway.Bloise is asked if Tonys car smelled like a dead body had been in the car. Bloise.>NO

Argument for Judgement of Acquittal

Jose Baez submitted memorandum to Judge Perry. He is familiar with most of the cases cited.
Cheney Mason is arguing for a Judgement on Acquittal based on the supposition that the prosecution did not make its case.  He is citing a Supreme Court case a in which "A judgement for acquittal should be granted when all evidence is circumstantial. It is the states responsibility" A direct acquittal is a very common move by a defense after prosecutors rest. (for appellate reasons as well). 
He is citing Dr. G stating that it is a homicide by undetermined means based on the duct tape.Mason states this is contrary to rules.  He cites CAs' lying is directly correlated to the death of Caylee Anthony. He states that it has not been shown who, why, when , where  and how Caylee died.

Count 1>  Premeditated Murder. Mason> excludes hypothesis for pre determination. Prosecution has not shown premeditation. Mason> There has been a stacking of evidence but no evidence of premeditation.
He cites a case of  a beauty queen named Donna Louise Smith who was found floating wrapped in  c. hains and a blanket. The husband did not report the death. Mason: Court in that case reversed 1st degree murder to 2nd bec. they couldn't prove manner of homicide  Mason states that the prosecution has not even shown how Caylee died. Mason also says state failed poorly to rebut the theory of drowning. Mason says CA was a loving, doting, caring mother.

Count 2>  Aggravated Child Abuse  State has not shown any evidence that Caylee was tortured or neglected. They have not show any intent to harm Caylee.  Mason says everyone who took stand was asked if Caylee was mistreated or tortured and the answer was no.
Count 3>  Aggravated Manslaughter   No evidence. The duct tape on or near Caylees remain has not been shown to be intentional but has been speculated. 


Count 4, 5, 6,>  He is not going to go into at this time . Judge Perry  asks if his argument over count 4,5,6 is a "late in the day." Mason said he already ruled on it. Apparently, he is arguing that Casey was not "mirandized." and her statements must be disregarded. Mason> Mason is again talking about the night deputies were called to Anthony home and CA was put in patrol car. (Miranda right issue). Casey was drivien around and surrounded (at Universal) by law enforcement and should have been mirandized. Mason is citing case law. Judge Perry leans back in his chair, covers his mouth and appears to be yawning. ME TOO. Casey  has a blank stare.
Mason: Argues that heart-shaped outline disappearing from duct tape akin to magical act. It went "Poof! Mason: No record of accidental death. He said "poof!" Also raised his hands.Judge asks what evidence is there of an accidental death? Mason says right now there isn't... Yet.Mason says there's nothing to exclude an accidental death either.Mason asks was she killed at all? Or was it an accident ? He also says it's the states burden to prove guilt.   When Mason mentioned grand father -George Anthony took a deep breath.  Mason comments on judge's experience and his own and says there is no evidence to say it was murder. Mason says counts 1,2,and 3 should be dismissed.

Linda Drane Burdick (LDB) steps up. Burdick points out that the defense has pointed out a cause of death.Burdick: State is not req. to rebut every scenario, but prove the facts.   Dr. G has refuted it. Burdick points Jackson v State, 2010, Alutein County, Florida. Page 532 of the opinion. LDB also says even George Anthony, accused of the cover up, denies this accidental death theory. LDB says a reasonable jury can conclude CA  died from 3 pieces of duct tape, by chloroform. Both she says.

Burdick: Reasonable jury can conclude Caylee died of duct tape on mouth and chloroform poisoning.
LDB says the application of duct tape (3 pieces) is premeditation. She says CA could have taken them off. LDB also says a jury can conclude CA started plotting this as early as March when she searched "chloroform" on computer. LDB days the motive would have been rift between mother/ daughter. 
 Burdick: Reas. jury can conclude CA  prepared for elimination of child thru computer searches. Burdick: "Intentional act by the defendant to cause the child's death" LDB says it's their stand is that the jury can decide- Judge Perry doesn't have to.LDB says CA could have died from single act of abuse. (debuting the no torture or abuse defense talked about) . LDB says jury can decide victim was poisoned (chloroform) and that CA placed 3 pieces of duct tape over the mouth of her daughter. 




Mason: State has "dearth of errors."  Mason: No evidence whatsoever of poisoning by chloroform. Mason: Traces of chloroform from decomposition.  Mason: No chloroform related to death of child. Mason: "The duct tape had not been wound around this child's head at all." Mason: Only evidence of duct tape is George Anthony putting it on the gas can.  Mason says state is forcing guessing with speculation. 


Judge is about to call a recess but before we go he says he has read most of these cases. Says he spent most of wknd reviewing this case.

The state must decide whether Judgement for Acquittal is appropriate. Judge Perry is discussing the cases cited in arguments.   Premeditation is a statement of fact. (not circumstantial evidence) Nature of weapon, manner of weapon used.   JP reviews rules of circumstantial evidence. Judge says it's not states job to rebut every theory of death.  Judge is reviewing and discussing the cases submitted. Judge says from previous case it was up to a jury to decide whether premeditation exists. 
Judge now talking about a case where last known person to be seen with victim was atheist defendant. Onto another case (this is at least 3) judge received in making this decision. Remember before break Judge Perry says he has spent a lot of time reading case law as it relates to this case - especially over the wknd.
CA  whispers something to Jose Baez during Perry's reading of case law on acquittal.Judge is talking a lot about cases where there is only circumstantial evidence.  Judge states their is enough reason for the charges of Aggravated child abuse (there does not need to be prior history of child abuse) and how it relates to the charge of Felony Murder.  Therefore, he rejects the motion by defense for Judgement of Acquittal.  Judge Perry says in this case there are more than 1 single act:: duct tape, chloroform, statements made by CA.
This is not big news. It was expected. This motion for Judgement of Acquittal is protocal for a death penalty case after the prosecution rests. So tomorrow we move to the defense presenting their case. 
Should be interesting. Court recessed until tomorrow at 9am.
Jose Baez is on his phone, CA is looking at him. Cheney Mason isn't showing any facial expression.George and Cindy Anthony left court immediately.

Defense is arguing about the can with the smell of decomposition.  and allowing the jury to smell it.
Jury has arrived.
Stipulation> On july 2nd, 2008, Casey Anthony received a tattoo, Bella Vitae. The  defense and prosecution has accepted it as fact and it should be considered true. Casey said.  "yes sir" to Perry re: stipulation of July 2 'Bella Vita" tattoo meaning 'Beautiful Life."
Ashton enters into evident the pic of the tattoo and the can with the smell of decomp. They may use it later or the jury may smell it during deliberation.. . THE PROSECUTION RESTS ITS CASE

Court today

Short day in court today. The Prosecution is expected to rest it's case today. The Defense  is expected to argue for acquittal based on the Prosecution did not make its case against Casey Anthony.. Dr G, the medical examiner summed it up best. "There should never be duct tape on a 2 year olds face. That is why it is a homicide. " Also, "100% of accidents are reported." If Caylee drowned, per the defense, 911 should have been called. Why the coverup?
My theory> I am disturbed by the emails to Tony Rosciono (boyfriend) in which Casey responded when he wanted to come to the Anthony home to see her. "Just wait 2 more days and you can come over anytime." Also, she told Amy she was going to received the Hopespring home from Cindy Anthony. Then there are the google searches for neck breaking, spleen injury and others. Was she planning to kill George and Cindy after subduing them with chloroform?

End of day

Jurors dismissed. Juror 11 hand notepad to deputy. States it is full. Juror number 11 is a teacher, in his 30's, WM He believes in the death penalty and believes it is a necessary option.Mason is asking for a mistrial AGAIN.  Issues regarding heart shaped sticker. He says it has nothing to w case. Draws speculation.
Also, Mason says state tries to introduce remorse. Also brings up skull superimposed video again.State says getting a tattoo of beautiful or good life is unusual behavior if daughter is missing or taken against will.Judge Perry denies motion for mistrial.
.Defense says they could not move up witnesses so they will begin their case Thursday
The prosecution will rest their case tomorrow.  Defense tells judge they will be filing a motion for a directed verdict of acquittal tomorrow. Directed verdict of acquittal- defense will say state didn't make it's case, not presented enough evidence to support conviction.
Judge asks about grief expert depo. State says it will happen Saturday afternoon.Judge Perry states the defense could end late next week.

 Mr.Williams is the tattoo artist who gave CA the Bell Vitae tattoo.Bobby Williams stated that he has known the defendant, Casey Anthony for approximately seven years. 


Bella Vita translates from Italian to “Beautiful life” in English.Williams testified that he gave Casey the tattoo on July 2 2008. He stated that she had asked him for a tattoo with the words “Bella Vita” in a feminine style font. The tattoo was going to be put on the back of her left shoulder.  This was approximately 2 weeks after the defense claims that Caylee Anthony drowned in the Anthony family home pool.According to the prosecution, July 2 was 2 weeks after Casey Anthony murdered her daughter using chloroform and duct tape.


He says CA seemed "normal" she was on her phone through most of the time. She paid in cash.the tattoo was 65 dollars.They had pizza afterwards., urchased by CA, and shared with the workers in the shop. She came in on 15th to make another appt for 19th.July 2, 2008 was date of Bella Vita tattoo. When making appt for tattoo #2 was going to be a matching tat w/ friend but not concrete decision.CA said Caylee was w/ nanny. Told him Caylee would come in for the 19th appt. Williams says it's common in his line of work for ppl to get tattoo's in honor or memory of someone.
Baez cross    Baez asks if Williams did George or Cindy's tattoo's. He said no but state objected. Perry sustained .(FYI, >Cindy's says "Caylee Marie" with a butterfly. George's says "My Sunshine.)


Prosector  Frank George asked if CA seemed mournful. Objection/ side bar/ witness excused. 

Cindy Anthony




Cindy was at the airport in LA coming back to Orlando when they found out the remains were found.  July, 3, 2008 she notice "Teddy" Caylees bear was missing. Her  Pooh blanket was missing.
Burdick asks Cindy if hair style in jail video is the same as she had six months to a year.  Cindy is testifying to the processing of her hair. She dyes and gets highlights.
She is shown a pic of Caylee in a blue dress, It was taken the first two months in 2008.Caylee has long brown hair. Cindy testifies to the care of Caylee's hair.
Cindy is testifiying to the care of her hair. She states after Caylee was born she wore it short. She would highlight her hair.
Cidny is being shown a pic of Caylee and Casey. Casey is lying on the kitchen floor and Caylee is on top of here. They are both laughing. Cindy testifies it was take in early 2007.
Lee did not process his hair . He wears it short.
Casey's grandmother had been in the Sunfire. Prior to June 2008. She wears hee hair shoulder length. She does not know the last time she was in the car.
Cindy's brother may have been in the car. He has blonde hair.
Cindy testifies to having blue, black and maybe silver duct tape in the home. She knows she  use the black tape to wrap the No Trespassing signs.  All tape is kept in the garage. At the command center, duct tape was used to put up Caylee's pic. Cindy testifies but it was not duct tape from the home. She previously stated the duct tape at the command center was from home. Burdick is reviewing testimoney with her.
She is being shown her testimony.  She is testifying her George told her the vent cover was missing on the old  gas can and he put duct tape on the vent hole. 

Alina Borroughs, CSI w/OCSO

Crime scene investigator Alina Burroughs testified at the Casey Anthony trial on June 14, 2011, saying heart shaped stickers were found in Casey Anthony's bedroom.


Burroughs is a crime scene investigator and was out at crime scene in 2008 when Caylee's remains were discovered. 


She was also a part of search warrant executed at Anthony home. She is being shown evidence. It is an aerial view of the difference between the Anthony home and the site of Caylee's remains. She identifies it is then shown to the jury. Prosecutor Burdick is asking about the heart shape stickers that were found at the Anthony home during the execution of the search warrant.
Sidebar. Court shown a pix of a letter with a heart-shaped sticker on it.   The stickers were in a yellow box in a dresser in CA's bedroom.  The jury is shown  picture of the yellow box, looking into the  box, you see a purple envelope addrressed to Caylee with a red heart shape sticker.. (Is this a letter  that they would put in Caylee's mailbox located outside her playhouse?)

The witness is identifying other stickers found in Casey's bedroom.  Casey had alot of stickers!!!
She then identifies a sheet of metallic red heart shape sticker sheet with 3 stickers left on sheet.
Baez to cross. Baez is questioning the witness on the purple envelope that was mailed to Caylee.  It has a 37 seven cent stamp. Baez> do you know how long it has been since we had 37 cent stamps? Witness> I don't know. However, when you look at the envelope the heart sticker is over the mailing address. It would not have been able to be mailed with the heart shape sticker in place. You can not read address. It had to be placed after mailing. Baez asking if they found anything else in the house and if they found stickers in Cindys and Georges' room.  Burroughs explains the start-shaped stickers and Disney stickers, as well as scrapbook items. Burroughs does not remember child's artwork on the walls of CA bedroom.  BAez> shows witness an item and if she found it in the Anthony home. Witness> she is not comfortable commenting as she  is not sure.   Baez asks how far the school is from the Anthony home.   Baez wants her to guess how far the school is to the Anthony home. She states she is not comfortable making estimates. She refuses to give estimate but will only say it is "in the vincity." besides much prompting by Baez for her to give a number. 
She was at the Anthony home for 9 days. Baez wants her to comment on the traffic and flow  as it was policed during that time. He wants her to comment on a dead end on the road and no homes there. She states she did not go down that road so she cannot testify to homes being there or not. 
This witness is good. 
Burroughs is excused.
Baez calls last witness to the stand after she left the courtroom. Baez has found  the physical item he was trying to get her to testify whether or not it was found in the home.  It is entered into evidence.
Burroghs  puts gloves on and opens the evidence envelope carefully.  She testifies that this item was not at the Anthony home. It is a raised surface sticker. It is actually thicker than a sticker. 

Catherine Theisene FBI for 20-some years

Theisen is the Chief of Quality and Assurance Unit at FBI in Quantico. Theisen is an expert in mitochondrial DNA analysis. Theisen says her area of expertise can help exclude people from the evidence they have. Likely she'll talk about hair found in trunk. Jeff Ashton just asked about hair and buccal swabs. heisen is identifying evidence. Theisen: Explains mitochondrial DNA test used on evidence like shed hair, skeletal remains. Theisen says a mitochondrial DNA profile shows neither CA or Caylee can be excluded.This was very technical. No juror took notes. Basically she testified the hair (trunk) and buccal swab are the same- therefore CA or Caylee could be sourcheisen also says Cindy should be added to list. So the hair - neither CA or  CAylee or Cindy can't be excluded as source.
The hair from trunk also matches the hair mass found with remain. So because hair mass and trunk hair are matches- they match CA or CAylee or Cindy or Cindy - or even Lee.
Cross by Baez. Theisen says she knew about the case (generalities). Baez asks if she knew Lee Anthony once owned the Pontiac -objection/ sustained.Ashton is objecting to just about every question Baez asks. Most are sustained.

Elizabeth Fontaine, FBI Examiner

Fontaine trained with FBI. Fontaine works in FBI latent print unit. She speaks very clearly and slowly to the jury.     Fontaine said she received one piece of duct tape separately, but the other two pieces where stuck together. Fontaine looked at duct tape from remains. Fontaine examined tape, found on the remains, for latent fingerprints.  Evidence subjected to environmental factors” normally would not have latent prints, she said.   Fontaine explains the details to the jury. Very loud and clear. Fontaine knew tape was found on remains she examined fingerprints on tape.  Fontaine could not find fingerprints on tape. She did see something else though. She saw the outline of a heart on  the tape. All jurors listening to this. Sticker was the size of a dime. Glue looked like leftovers from a bandaid but in the shape of a heart. Noted it. This is all new to jury. They did NOT see the picture of heart stickers in Anthony's home on Saturday. Fontaine didn't take picture of heart sticker. Says not her job. She examines for fingerprints.


Fontaine: Explains how she collects latent prints from evidence..Fontaine: Said percentage of certain of population  has naturally fluorescing fingerprints due to oils, lotions. Fontaine: Explains the use of Super Glue in lifting fingerprints like in CSI series. Fontaine: Explains dye stains Super Glue residue, makes it glow orange.  Fontaine: Final step is black powder brushed over evidence. Powder is attracted to oils in latent prints.Baez cross starts now. Fontaine is 2nd person to look at duct tape. 3 pieces examined. She looks for visible prints first. Two pieces of tape were stuck together. Fontaine explains to jury like a science teacher. It's helpful to understand.  Fontaine referred to the show CSI to help explain. Using simple steps too. This is complicated work. Fontaine is very likable. Laughs when explaining and refers to show CSI it's very relatable. Sidebar.
No picture of heart sticker it will depend on if jury believes Fontaine and that she saw the residue.
Casey leans towards attorneys at sidebar with judge. Almost like she's trying to hear something.aez just came back to defense table to ask a question. CA shook her head "no" hmmm?.
Prosecution has no more witnesses until tomorrow . May wrap up tomorrow afternoon--- earlier than expected. Defense may start Wednesday. Jury Deliberations may start June 25th.

Stephen Shaw , FBI fiber examiner.





First witness called Stephen Shawl he is an FBI fiber examiner.  Shawl examines hair fibers. He is considered an expert witness. Shaw (spelled correctly) examined a hair found in a hairbrush. Shaw says he found signs of decomposition on the hair. We're back to talking about hair bands and the hair in Anthony's trunk. The hair matched the hair in the brush. But Shaw says it is not a means of positive identification.  Shaw's answers are long and scientific. A few jurors gaze off a bit when he explains the details of a hair.CA has moved over to sit in Baez seury asked to step out just 22 minutes in.at next to Mason while attorneys talk to judge during sidebar.
Jury asked to step out just 22 minutes in.Defense says they haven't seen the PowerPoint Shaw did and is going to talk about.Defense will now get a chance to see the PowerPoint b4 it is discussed in front of the jury. Shaw explaining it.We are going through every page of the PowerPoint. Defense is asking questions about the pictures. We may have to go through this twice. This may take awhile defense needs to see the pics then jury will go through it again. These are microscopic images of hairs. The hairs look like long earth worms close up like this.  It's always called "apparent decomposition" it's the experts way of saying it shows the signs but they can't be sure. Again- jury not in courtroom. Baez wanted to see the PowerPoint b4 the witness was questioned about it. Now onto 2nd PowerPoint. is watching her monitor. Each hair picture in a little circle the "eye" of the microscope.
Prosecutors at times chuckle to themselves during Baez questioning of witness. At one point Ashton shakes his head "no" during a question.Baez wants this PowerPoint thrown out. Says it was designed for this case & it's not accurate to compare hairs found in diff. regions.Judge asks questions abt when state got this PowerPoint and when the pictures were given to them. Defense says only got black & white pics.Defense says they never got color copies of hair pictures. Simme speaking now abt it. CA  watches her speak. Simms explaining she never got pictures in color. 
Judge will NOT allow Powerpoint. Court finds it "troubling" it was not given to defense ahead of time. A win for the defense. 
No pictures but testimony stands. It's been a dry morning. Jury still outside of courtroom. The hair expert has pretty good hair himself. 
Jury is back ready to listen to hair study. Shaw says the study was a priority bc of this case. Shaw used hair samples from 15 ppl. The hairs were pulled from males & females ages 3-53. 
This hair picture will be used. No objections from defense--- yet*Simms explaining she never got pictures in color. Jury looking at picture of hair with apparent decomposition. It has a black band in the middle of the hair

Gerald Johnston, Owner, Allan and Company, Land Surveyor






Johnston is a land surveyor called in by OCSO. Looking at 3D image of Suburban Drive. Johnston did 3D fly over compares the look of it to being in a video game. Murdock, the last witness, provided data to the firm so they could create the 3-D animation Casey Anthony looking away. The images are not gruesome just a computerized map. Johnston made 3d  map of crime scene area.
